<description>My son, wife and 14mth old baby traveled to Cancun, Mexico on the 26th April 2009 after seeking the advice of the UK Foreign Office ,who told them that it was ok to travel and that there was no danger to their selves. Upon arriving the foreign office changed their minds and stated on the 27th that only essential travel to Mexico should be under taken, because of the fear of their baby contracting Swine Flue, especially at such a young age, they asked their tour operator Thomas Cook to get them back home to the UK. Apparently all flights into Cancun were suspended and they had to wait around on standby for a further 3 days to get a flight, they eventually got a flight, after which there were no more flights and they would have been stranded in Cancun against their wishes.
After arriving back in the UK they were contacted by Thomas Cook and told that another passenger on their flight home was confirmed as having contracted Swine Flu and that they should seek medical advice, this they did and were all put on a course of Tamiflu just in case.
They are now trying to seek compensation for the cost of the holiday that they lost with Norwich AXA Insurance, the question that I beg to ask is have they got a good case and should the insurance compensate them, if not in full at least for the days lost.
Any answer or advice that you can give me would be greatly appreciated.
Thanking you in advance.
